It is generally acknowledged that a certain amount of state intervention in health and health care is needed to address the significant market failures in these sectors; however, it is also thought that the primary rationale for state involvement in health must lie elsewhere, for example in an egalitarian commitment to equalizing access to health care for all citizens. This paper argues that a complete theory of justice in (...) health can be derived from a commitment to correcting market failure, or in other words promoting Pareto-efficiency, in the domain of health. This approach can address familiar problems around access to care, as well as problems related to resource allocation and rationing, the control of health care costs, and the foundations of public health. Egalitarian theories of justice in health cannot make sense of the depth and pervasiveness of state involvement in health and health care; only a theory rooted in the need to correct market failure can. Inducing the rubber hand illusion (RHI) requires that participants look at an imitation hand while it is stroked in synchrony with their occluded biological hand. Previous explanations of the RHI have emphasized multisensory integration, and excluded higher cognitive functions. We investigated the relationship between the RHI and higher cognitive functions by experimentally testing task switch (as measured by switch cost) and mind wandering (as measured by SART score); we also included a questionnaire for attentional control that comprises two subscales, attention-shift (...) and attention-focus. To assess experience of RHI, the Botvinick and Cohen (1998) questionnaire was used and illusion onset time was recorded. Our results indicate that rapidity of onset reliably indicates illusion strength. Regression analysis revealed that participants evincing less switch cost and higher attention-shift scores had faster RHI onset times, and that those with higher attention-shift scores experienced the RHI more vividly. These results suggest that the multi-sensory hypothesis is not sufficient to explain the illusion: higher cognitive functions should be taken into account when explaining variation in the experience of ownership for the rubber hand. To improve oneself and grow professionally, career development has been found to be crucial, as it serves as a roadmap for the professional growth of employees. However, a barrier, known as the glass ceiling, hinders the progress of employees, especially those in the LGBTQIA+ community. This study explores the impact of the glass ceiling on the career development of selected LGBTQIA+ individuals, shedding light on the barriers faced by this community in the workplace. The researchers used a qualitative multiple-case study (...) and selected ten (10) LGBTQIA+ participants from large enterprises via the judgmental sampling technique. Through thematic analysis, psychological impact, workplace discomfort, lack of recognition, and career progress challenges emerged as the impacts of the glass ceiling on the participants. Strategies for overcoming glass ceiling barriers, such as resilience, self-reflection, and community support, are identified. Thus, the study found that glass ceilings are really evident in the context of businesses. With this, the proposed advocacy plan in the study suggests interventions like workplace inclusion training, mentorship networks, and seminars on employee rights. Furthermore, it emphasizes the call for ongoing research and advocacy efforts to dismantle barriers and cultivate workplaces that not only embrace diversity but also provide equitable opportunities for career growth. Psychopathy is a personality disorder characterized by callous antisocial behavior and criminal recidivism. Here we examine whether psychopathy is associated with alterations in functional connectivity in three large-scale cortical networks. Using fMRI in 142 adult male prison inmates, we computed resting-state functional connectivity using seeds from the default mode network, frontoparietal network, and cingulo-opercular network. To determine the specificity of our findings to these cortical networks, we also calculated functional connectivity using seeds from two comparison primary sensory networks: visual and (...) auditory networks. Regression analyses related network connectivity to overall psychopathy scores and to subscores for the “factors” and “facets” of psychopathy: Factor 1, interpersonal/affective traits; Factor 2, lifestyle/antisocial traits; Facet 1, interpersonal; Facet 2, affective; Facet 3, lifestyle; Facet 4, antisocial. Overall psychopathy severity was associated with reduced functional connectivity between lateral parietal cortex and dorsal anterior cingulate cortex. The two factor scores exhibited contrasting relationships with functional connectivity: Factor 1 scores were associated with reduced functional connectivity in the three cortical networks, whereas Factor 2 scores were associated with heightened connectivity in the same networks. This dissociation was evident particularly in the functional connectivity between anterior insula and dorsal anterior cingulate cortex. The facet scores also demonstrated distinct patterns of connectivity. We found no associations between psychopathy scores and functional connectivity within visual or auditory networks. These findings provide novel evidence on the neural correlates of psychopathy and suggest that connectivity between cortical association hubs, such as the dorsal anterior cingulate cortex, may be a neurobiological marker of the disorder. It has become evident that mind–body supervenience, as merely specifying a covariance between mental and physical properties, is consistent with clearly non-physicalist views of the mental, such as emergentism. Consequently, there is a push in the physicalist camp for an ontologically more robust supervenience, a “superdupervenience,” that ensures that properties supervening on physical properties are physicalistically acceptable. Jessica Wilson claims that supervenience is made superduper by Condition on Causal Powers (CCP): each individual causal power associated with a supervenient property (...) is numerically identical with a causal power associated with its base property. Furthermore, according to Wilson, a wide variety of physicalist positions, both reductive and non-reductive, can be seen as relying on CCP to ensure that properties supervening on physical properties are physicalistically acceptable. I argue that imposing CCP on mind–body supervenience fails to ensure that mental properties are physicalistically acceptable. The problem, I contend, is that while CCP may guard against supervenient mental properties being insufficiently grounded in their physical bases it fails to guard against supervenient mental properties being too deeply grounded in their physical bases. Prop oriented make-believe is make-believe utilized for the purpose of understanding what I call “props,” actual objects or states of affairs that make propositions “fictional,” true in the make-believe world. I, David Hills, and others have claimed that prop oriented make-believe lies at the heart of the functioning of many metaphors, and one variety of fictionalism in metaphysics invokes prop oriented make-believe to explain away apparent references to entities some find questionable or problematic (fictional characters, propositions, moral properties, numbers). Elisabeth (...) Camp has argued against my and David Hills’ views of metaphor. Her arguments, many of them echoed by Catharine Wearing, demolish a very implausible account of metaphor, but leave entirely untouched the views that Hills and I actually proposed. Clarifying what we say about metaphor serves also as a defense of fictionalist theories that invoke prop oriented make-believe. (shrink)

This article introduces the idea of ‘dependence subtexts’ to explain how the stories that we encounter in property theory and public rhetoric function to make some actors appear ‘independent’, and thus capable of acquiring property in their own right, while making other actors appear ‘dependent’ and thus incapable of acquiring property. The argument develops the idea of ‘dependence subtexts’ out of the work of legal scholar Carol Rose and political theorist Carole Pateman, before using it as a tool for contrasting (...) the canonical property stories of John Locke and Pierre-Joseph Proudhon. We argue that the link between property and dependence provides a useful starting point for understanding issues of economic justice that share a common political problem: how do we choose to govern the relation between dependence and independence through the institution of property? The dissertation traces the development of what I call “the problem of partiality” through the work of certain key figures in the British Moralist tradition: John Locke, Catharine Trotter Cockburn, Anthony Ashley Cooper (the Third Earl of Shaftesbury), Francis Hutcheson, John Gay, David Hume, Joseph Butler, and Adam Smith. On the one hand, we are committed to impartiality as a constitutive norm of moral judgment and conduct. On the other hand, we are committed to the idea that it is (...) permissible, or even obligatory, to expend disproportionate resources promoting the good of our loved ones over the good of strangers. However, these two commitments conflict with one another. This problem challenges us to provide an account of the scope and limits of reasonable partiality that does justice to both commitments. I argue that confronting this tension is a central project of early modern ethics. I offer a rereading of the British Moralist tradition, centered on debates about partiality, and thereby shift discussion of the tradition away from concerns about meta-ethics and moral epistemology, to issues of practical ethics. The topic of partiality remains central in contemporary ethics, as is evident in ongoing debates about the place of empathy in moral judgment, and the role of love in shaping our moral commitments. Though the aim of the dissertation is not to settle questions about the scope and limits of reasonable partiality, the focus here remains fixed on how the concept of partiality was problematized in our ethical thought, and how it informs our discussions in normative ethics and moral psychology. Alongside building a bridge between early modern scholarship and recent work in ethics, the dissertation casts light on two understudied figures in the British Moralist tradition – Cockburn and Gay – who contributed greatly to debates about partiality. By examining their contributions, I reconsider their place in the history of modern ethics and therefore provide a more contextualized account of philosophical thought in the period. (shrink)

This paper describes our reconstruction of the apparatus used in C.S. Peirce and Joseph Jastrow’s 1885 psychophysical experiment, “On Small Differences of Sensation” and how it relates to persistent questions in scientific theories of measurement. We situate Peirce and Jastrow’s work in the broader context of nineteenth-century discussions about the status of psychology as a science and emphasize the role of measurement and experiment in determining that status. Through our re-enactment of the experiment, we analyze the experiment’s methodology, which (...) features blinding, randomization, noise control, and a technology for data recording. Our claims are illustrated by images of historical and reconstructed apparatuses, as well as graphs of the data collected in our reproduction. Our findings exemplify the relevance of history of psychology for contemporary philosophy of science and theories of measurement, and defend experimental reconstructions as a particularly fertile method of inquiry in the history of psychophysical sciences. Joseph Raz’s obituary of H.L.A. Hart for Utilitas raises certain puzzles, especially for readers coming from the research area analytic political philosophy. I present three puzzles.

After a brief introduction about the problem of leopardian sources, I wish to introduce here a description of the diffusion of Addison’s theories about the Imagination in Italy at the time of Leopardi, trying to highlight their influence on his thinking and his philosophy. The third chapter is dedicated to the analysis of an important excerpt of the Zibaldone where Leopardi quotes Addison and his Catone to introduce an interesting reflection about the pleasure of beauty and the role of imagination, (...) almost as a way to face Addison issues.This excerpt represents an occasion to compare the theories of Addison and Leopardi about Aesthetics and also the similarities and the differences between them. Nearly thirty years ago, Robert Alexy in his book The Concept and Validity of Law as well as in other early articles raised non-positivistic arguments in the Continental European tradition against legal positivism in general, which was assumed to be held by, among others, John Austin, Hans Kelsen and H.L.A. Hart. The core thesis of legal positivism that was being discussed among contemporary German jurists, just as with their Anglo- American counterparts, is the claim that there is no necessary connection (...) between law and morality. Robert Alexy has argued, however, that the law, besides consisting conceptually of elements of authoritative issuance and social efficacy, necessarily lays a claim to substantial correctness, which is derived from analytical arguments. Furthermore, if this claim to substantial correctness necessarily requires the incorporation of moral elements into law, then the ‘necessary connection thesis’, as defended by non-positivism, can be justified. Some of the most significant objections to this sort of claim, stemming from the Anglo-American world, are those introduced by Joseph Raz. In his ‘Reply’ to Robert Alexy, Raz raises at least three interesting criticisms, including, first, the ambiguity of ‘legal theory in the positivistic tradition’, second, the indeterminate formulations of the ‘separation thesis’, and, third, the necessary claim of law to legitimate authority as a moral claim. As a point of departure, I will argue that Raz’s three criticisms are misleading. For they do not enhance our understanding of the genuine compatibility or incompatibility between legal positivism and non-positivism. Despite the frequently reformulated theses of legal positivism and the various kinds of opponents responding thereto, the essential divergence between legal positivism and non-positivism was and remains the answer to the question of the relation between law and morality. Furthermore, I will clarify that in the strictest sense there can be three and only three logically possible positions concerning the relation between law and morality: the connection between them is either necessary, or impossible (i. e. they are necessarily separate), or contingent (i. e. they are neither necessarily connected nor necessarily separate). The first position is non-positivistic, while the latter two positions are, indeed, both positivistic, but in different forms: one may be called ‘exclusive’ legal positivism, the other ‘inclusive’ legal positivism. I will continue by showing that these three positions stand to one another in the relation of contraries, not contradictories, and that, taken together, they exhaust the logically possible positions concerning the relation between law and morality, never mind the tradition or authority from which these positions are derived. Raz mentions, however, many changeable formulations of the separation thesis, which even leads him to acknowledge ‘necessary connections between law and morality’. One who is trying to understand legal positivism would no doubt be puzzled by this claim. Nevertheless, I will argue that this is an alternative strategy of legal positivism, and it points to naturalistically oriented view. Although this necessary separation between law and morality, understood naturalistically, strikes one as strengthening the separation, in the end it leads to a weakened notion of necessity. This weakened necessary separation thesis, however, cannot be justified through the so-called claim of the law to legitimate authority, defended by Raz, for it is difficult to answer the question of whether a normally justified but factual authority can gain legitimate authority. Finally, the necessary connection between law and morality in a strong sense can still be justified by the claim of law to correctness, as per Alexy’s argument. (shrink)

I identify what appears to be a "glaring" inconsistency between what Joseph Raz says on euthanasia in a 2012 lecture and what he says on well-being within his most celebrated book, The Morality of Freedom. There also appears to be a subtler inconsistency between what he says and his endorsement of H.L.A. Hart’s opposition to a definitional project.

The chapter discusses how the cleavage between the Continental and the Anglo-American philosophies originated, the (self-)images of both philosophical worlds, the converging rediscoveries from the Seventies, and recent ecumenic or anti-ecumenic strategies. I argue that pragmatism provides an important counter-instance to the familiar self-images and the fashionable ecumenic or anti-ecumenic strategies. The conclusions are: (i) the only place where Continental philosophy exists (as Euro-Communism one decade ago) is America; (ii) less obviously, also analytic philosophy does not exist, or does no (...) more exist as a current or a paradigm; what does exist is, on the one hand, philosophy of language and, on the other, philosophy of mind, that is, two disciplines; (iii) the dissolution of analytic philosophy as a school has been highly fruitful, precisely in so far as it has left room for disciplines and research programmes; (iv) what is left, of the Anglo-American/Continental cleavage is primarily differences in styles, depending partly on intellectual traditions, partly owing to sociology, history, institutional frameworks; these differences should not be blurred by rash ecumenism; besides, theoretical differences are alive as ever, but within both camps; finally, there is indeed a lag (not a difference) in the appropriation of intellectual techniques by most schools of 'Continental' philosophy, and this should be overcome through appropriation of what the best 'analytic' philosophers have produced. In this essay, I argue that Valéry's poetic reflections offer valuable insights on the ancient (Aristotelian) ideal of beauty as perfection, which he rehabilitates and updates. I also show that these clarifications provide solutions to enduring aesthetic problems. To do this, I start from the modal vocabulary (necessary, possible, arbitrary) Valéry uses each time he wants to describe the relationship of an author to his composition. He therefore seems to have been deeply fascinated by the tension between the fact that (...) a creator is always free to compose what he wants, and the fact that the same creator wants his work or parts of it to be imposed on him, while he is in the midst of his creative process. Here comes into play the ideal in question, since the perfection of a work implies, among other things, that one cannot want to modify this work for the better (being already perfect). After a detour aiming to introduce the importance of the rules of composition and to refute the idea that this ideal would no longer have any relevance in a modern artistic perspective, I detail what could be called the "aesthetic holism" of Valéry, which retains from a work only its formal dimension, considered in an original way as a formal whole composed of other formal parts. It is therefore above all a form that must be perfected, against possible relative deprivations (lacks or defects). Then, I link (with the help of Wittgenstein) the modal vocabulary to this notion of form which, by posing compositional challenges, turns out to be essential to the understanding of beauty as perfection. -/- Dans cet essai, je soutiens que les réflexions poétiques de Valéry offrent des éclaircissements particulièrement précieux sur l’idéal ancien (Aristotélicien) de beauté comme perfection, qu’il réhabilite et réactualise. Je défends également l’idée que ces éclaircissements peuvent nous mettre sur la voie de solutions à des problèmes endurants de l’esthétique. Pour ce faire, je pars de l’usage remarquable que Valéry fait d’un vocabulaire modal (nécessaire, possible, arbitraire) chaque fois qu’il veut décrire de quelle manière un auteur se rapporte à sa composition. Il apparaît ainsi que ce qui a profondément fasciné Valéry, c’est le dilemme ou la tension selon laquelle tout en étant libre de composer comme il l’entend (en laissant libre cours à sa fantaisie), un créateur aspire néanmoins à ce que son œuvre ou les parties de cette dernière s’imposent à lui, pendant qu’il crée. Ici entre en jeu l’idéal en question, car la perfection d’une œuvre implique entre autre chose que nous ne puissions vouloir modifier cette œuvre pour le mieux (celle-ci étant justement déjà parfaite). Après un détour visant à introduire l’importance des règles de composition et à réfuter l’idée que cet idéal n’aurait plus de pertinence dans une perspective artistique moderne, je détaille ce que l’on pourrait appeler le « holisme esthétique » de Valéry, qui ne retient de la composition d’une œuvre que sa dimension formelle, envisagée de manière originale comme une totalité faite d’autres parties formelles. C’est donc avant toute chose une forme qu’il faut parfaire, contre d’éventuelles privations relatives (manques ou défauts). Il s’agit alors de connecter (à l’aide de Wittgenstein) ce vocabulaire modale à cette notion de forme qui, en posant des enjeux de composition, se révèle indispensable à la compréhension de la beauté comme perfection. Après une défense à contretemps des traditions formelles dans la création (puisque ce sont de telles traditions qui constituent les ressources par lesquelles un individu libre et autonome peut vouloir, non seulement se faire l’héritier de ces traditions, mais aussi se montrer original et innovant), je termine en appliquant les idées de Valéry au débat qui a opposé un camp « généraliste » à un camp « particulariste » en matière de raisons esthétiques. The article examines the issue of a necessary connection between the phenomena of law and morality. According to legal positiv- ism, morality is not a criterion of the legitimacy for legal norms. The law can have any content including absolutely immoral (the so-called “separability thesis”). Law issues are not connected with discussing the moral merits of a possible judicial decision. They are only closely related to studying various purely legal phenomena like precedents, judicial discretion, legislatures, etc. The ascriptive legal statements (...) theory proposed by the Oxford School of Law (Herbert Hart, Joseph Raz, and others) serves as the core of contemporary legal positivism. This theory is based on the notion of defeasibility for legal responsibility without any moral reasoning. There, phenomena of law are interpreted as purely linguistic, not social constructions. Analysis of pure law language should provide all the needful tools to extract hidden meaning from any legal norm. This analysis does not require going beyond the legal language since it does not describe any real situations in the world, but merely expresses legal requirements, allowing to legally qualify some observed events. It completely eliminates any references to moral principles from the analysis of legal language. However the critical reconstruction theory of ascriptive legal statements shows limitations of the legal positivism’s analytical approach to the phenomena of law. The example of a fictitious legal collision offered demonstrates limitations of the legal positivism approach to the understand- ing of law phenomena. This collision is a complex conceptual mix of Frankfurt-style examples and imaginary situations in the Trolley Problem widely known in analytical ethics. It clearly demonstrates the possible paradox of a law judgment in situations where conditions for the recognition and cancellation of legal liability are the property of two different (not necessarily openly contradictory) legal norms. It can serve as a strong argument in favor of contemporary theories of natural law (Lon Fuller, John Finnis, Ronald Dworkin, and others), which questioned the possibility of creating a theory of pure law. They considered it senseless and impossible to draw any strict border between moral and legal norms. Immoral law cannot have the particular property of creating a moral obliga- tion to follow such like a law. Law cannot be built on legality only, and the answers to all significant legal questions should be found in moral theories. (shrink)

I examine the impact of the presence of anarchists among key legal officials upon the legal positivist theories of H.L.A. Hart and Joseph Raz. For purposes of this paper, an anarchist is one who believes that the law cannot successfully obligate or create reasons for action beyond prudential reasons, such as avoiding sanction. I show that both versions of positivism require key legal officials to endorse the law in some way, and that if a legal system can continue to (...) exist and function when its key officials reject the reason-giving character of law, then we have a reason to re-examine and amend legal positivism. Joseph Almog says concerning “a certain locus where Quine doesn’t exist…qua evaluation locus, we take to it [singular] propositions involving Quine [as a constituent] which we have generated in our generation locus.” This seems to be either murder, or worse, self-contradiction. It presumes that certain designators designate their designata even at loci where the designata do not exist, i.e., the designators have “Kaplan rigidity.” Against this view, this paper argues that negative existentials such as “Quine does not exist” are (...) true only at ordered couples of loci (times or possible worlds) < l, l’ > such that the constituents of the truthmaker are the designatum itself from l and whatever corresponds to “does not exist” from l’. G. E. L. Owen, in his infl uential paper “Inherence,” talks of “vink,” a name he has created for a particular shade of the color pink, and this “vink” serves as an individual in the Aristotelian category of quality. Owen was one of the first to aim to discredit the belief that J. L. Ackrill and his camp espoused, the belief that Aristotle thought that “general attributes are not in individuals, particular attributes are not in more than one individual.” (...) I postulate that there is nothing here that does not preclude the existence of transferable nonsubstantial particulars, and base this view on passages from Aristotle’s Categories and certain examples found in Ammonius’s commentary and On Colors. Given this, a nonsubstantial particular of “vink” would not have to rely on having inhered in just one particular body to have existence, however, it would have to inhere in at least one particular body. The speech-act approach to rules is commonplace in both Anglo-American and continental traditions of legal philosophy. Despite its pervasiveness, I argue in this paper that the approach is misguided and therefore intrinsically flawed. My critique identifies how speech-act theory provides an inadequate theoretical framework for the analysis of written discourse, a case in point being legal text. Two main misconceptions resulting from this misguided approach are the fallacy of synchronicity and the fallacy of a-discursivity. The former consists of treating legal (...) rules as if they were uttered and received in the same context, the latter consists of treating legal rules as relatively short, isolated sentences. Among the consequences of these fallacies are an excessive focus on the lawmakers’ semantic intentions and the neglect of the semantic and pragmatic complexity of rules as sets of utterances (discourses) -/- To redress these flaws, I propose analysing legal rules through the prism of complex text-acts. My paper presents the consequences of this revised approach for legal interpretation, supporting Joseph Raz's idea of minimal legislative intent. (shrink)

(Spanish) RESUMEN: La libertad absoluta postulada por Viktor Emil Frankl y Jean-Paul Sartre, la Shoah y la creencia en un dios omnipotente, bueno y justo parecen contradecirse. La pregunta por el sentido del sufrimiento de las víctimas del Holocausto (la verdadera catástrofe, el mayor crimen contra la humanidad), simbolizado por Auschwitz, y como punto de inflexión en la historia, es terriblemente dolorosa y parece no tener una respuesta filosófica ni teológica. A mi juicio, es importantísimo distinguir entre las víctimas inocentes (...) de la Shoah que perecieron y las víctimas inocentes que sufrieron un verdadero infierno y perdieron a sus seres queridos, pero que lograron sobrevivir. Ambas son víctimas, por supuesto, pero así como encontrarle un posible sentido al sufrimiento de las víctimas masacradas y gaseadas podría suponer un insulto a su sufrimiento y agonía –en especial, al horror que sufrieron los niños–, el horrible sufrimiento de los supervivientes pudo dar, tal vez, de alguna manera, un sentido a sus vidas después de la liberación de los campos de concentración y exterminio, ya fuera como voz, como protesta o como simple supervivencia. Frankl apuesta por un sentido último (que abraza el sentido del sufrimiento de las víctimas), y Sartre, aunque parezca no apostar por sentido alguno, volcó su vida al compromiso político después de la Segunda Guerra Mundial, y ello parece vislumbrar una minúscula pizca de sentido después de la barbarie. La filosofía de Frankl es un sí a la vida incluso en las situaciones más extremas, un grito casi nietzscheano que exalta el valor de la vida más allá de cualquier sufrimiento. Frankl, padre de la logoterapia y superviviente del Holocausto, abre una puerta a Dios al hablar de un dios inconsciente, una dimensión suprahumana y una fe incondicional, y define la religión como espiritualidad y como la búsqueda del hombre por el sentido último. Según Frankl, la libertad no se contradice con Dios, y la religión existe no a raíz de la barbarie, sino a pesar de la barbarie. El existencialismo sartreano es una filosofía de la libertad radical y de la responsabilidad. El hombre está condenado a ser libre. El ser humano es un ser en el que la existencia precede a la esencia. Somos totalmente responsables de lo que somos. Sartre afirma que la libertad humana es incompatible con Dios. En un mundo sin Dios, la moral la construyen los hombres, con sus propias decisiones y sus acciones, y la existencia y el sufrimiento de las víctimas no tienen sentido alguno. Sartre define al hombre como libertad, responsabilidad, angustia y contingencia. Frankl define al hombre como libertad, responsabilidad, espiritualidad y búsqueda de sentido. Con esta tesis me propongo entrar en la resbaladiza dimensión del dolor, la desesperación, el sentido y sinsentido del sufrimiento de las víctimas (teniendo presente los horrores de Auschwitz, que en teología y filosofía ha simbolizado desde la liberación de los campos la muerte de Dios y la muerte de la moral). Es verdad que no solo los hombres, mujeres y niños judíos fueron víctimas de la barbarie alemana, pero, como reza el mensaje de Elie Wiesel en la exposición permanente del Block 27 del Auschwitz-Birkeanu State Museum: "Not all victims were Jewish in this place, but all Jews were victims". La Shoah no es un episodio dentro de la Segunda Guerra Mundial, sino un punto de inflexión en la historia de la humanidad, y es una catástrofe que nos concierne a todos, hombres y mujeres judíos y no judíos, religiosos e irreligiosos, creyentes e increyentes, como seres libres, responsables y morales que somos –o que deberíamos ser. Muchas de las víctimas del Holocausto, en medio de la desesperación, entraron en las cámaras de gas orando, aferrándose a la esperanza de que ese final espeluznante no era un punto final. Con esta tesis no me propongo de ninguna manera responder a la eterna pregunta de si Dios existe o no, sino que propongo interpretar ese grito hacia Dios como un desesperado anhelo de esperanza. También me propongo encontrar una coherencia en las posturas de estos dos grandes pensadores para quienes la libertad y la responsabilidad definen al hombre: Frankl (quien apuesta por una dimensión suprahumana donde existe un sentido último en el que el sufrimiento de las víctimas tiene que tener algún sentido, aunque ese sentido sea completamente incomprensible en la dimensión humana) y Sartre (el existencialista ateo por excelencia, para quien el mundo, la existencia y el sufrimiento son absolutamente contingentes). En el primer capítulo expongo la logoterapia y el existencialismo sartreano: describo las tres dimensiones del hombre y las tres búsquedas de sentido propuestas por Frankl, y expongo las cinco consecuencias de "l'existence précède l'essence", centrándome en la libertad y la responsabilidad, y hablo del suicidio. El segundo capítulo está dedicado al dios inconsciente frankleano, la dimensión suprahumana, la búsqueda por el sentido último y la fe incondicional. En el tercer capítulo ilustro la libertad sin Dios sartreana, la ontología sartreana, el ateísmo sartreano y el humanismo sartreano, y hablo sobre la responsabilidad, la mauvaise foi, la contingencia, la situation y la angustia. The question of the meaning of the victims' suffering of the Holocaust (the true catastrophe, the biggest crime against humanity), simbolised by Auschwitz and as a turning point in History, is terribly painful and doesn't seem to have an answer. In my opinion, it's crucial to distinguish between the innocent victims of the Shoah who perished and the innocent victims who sufferend a real hell and lost their loved ones, but managed to survive. Both are victims, of course, but just as finding a possible meaning to the suffering of the massacred and gassed victims could result in an insult to their suffering and agony –especially to the horror that the children suffered– the gigantic suffering of the survivors could, maybe, somehow, give a meaning to their lives after the liberation of the concentration and extermination camps, either as a voice, as a protest, or as a simple survival. Frankl believes in an ultimate meaning (that embraces the meaning of the victims' suffering), and Sartre, even if it appears not to embrace any meaning, turned his life to political engagement after War World II, and that attitude seems to give a tiny glimpse of meaning after the barbarity. Frankl's philosophy says yes to life even in the most extreme situations, and it's a Nietzschean-like scream that exalts the value of life beyond any monstrous suffering. Frankl, the father of logotherapy and a Holocaust survivor, opens a door to God when he talks about an unconscious God, a supra-human dimension and an unconditional faith; he defines religion as spirituality and as man's search for ultimate meaning. According to Frankl, freedom is not contradictory with God, and religion exists not because of the barbarity but in spite of the barbarity. Sartrean existentialism is a philosophy of radical freedom and responsibility. Men are condemned to be free. We are beings where the existence precedes the essence. We are completely responsible of what we are. Sartre argues that human freedom is incompatible with God. In a godless world, morality is constructed by people, with their own choices and actions, and human existence and the suffering of the victims don't have any meaning. Sartre defines man as freedom, responsibility, Angst and contingency. Frankl defines man as freedom, responsibility, spirituality and search for meaning. With this dissertation I attempt to enter in the slippery dimension of the pain, despair, meaning and meaninglessness of the victims' suffering (having in mind the horrors of Auschwitz, that in theology and in philosophy have simbolised, since the liberation of the camps, the death of God and the death of morality). It's true that not only Jewish men, women and children were victims of the German barbarity, but, as Elie Wiesel's message from the permanent exhibition from Block 27 of the Auschwitz-Birkeanu State Museum reads: "Not all victims were Jewish in this place, but all Jews were victims". The Shoah is not an episode inside War World II, but a turning point in the history of humankind, and a catastrophe that embraces us all, Jewish and not not Jewish men and women, religious and not religious, believers and not believers, as the free, responsible and moral beings that we all are –or that we should be. A lot of the victims, in the midst of their desperation, entered into the gas chambers praying, holding to the hope that their horrifying end was not the ultimate end. With this dissertation I do not attempt to answer the eternal question of the existence of God, rather, I will try to interpret that scream to God as a longing for hope. I also intend to find a coherence between the thought of these two great thinkers for whom freedom and responsibilty define man: Frankl (who argues that there is a suprahuman dimension where an ultimate meaning exists and where the victims' suffering has to have a meaning, even if this meaning is completely incomprehensible in the human dimension) and Sartre (the atheist existentialist par excellence, for whom the world, human existence and suffering are absolutely contingent). In the first chapter I expose logotherapy and Sartrean existentialism: I describe the three dimensions of man, the three searches for meaning, the five consequences of "l'existence précède l'essence" and I speak about suicide. The second chapter delves into the unconscious God, the supra-human dimension, the ultimate meaning and the unconditional faith. In the third chapter I expose the freedom without God defended by Sartre, Sartre's ontology, Sartre's atheism, Sartre's humanism, and his ideas about responsibility, mauvaise foi, contingency, situation, and Angst. The fourth chapter is necessarily historical (while being philosophical too): I wonder about the death of God after Auschwitz, I argue and defend the uniqueness of the Holocaust (the Shoah is a turning point in the history of humankind), I describe the massacres before the extermination camps (Einsatzgruppen, Ordnungspolizei y Wehrmacht), the gigantic Auschwitz camp complex (Stammlager, Auschwitz-Birkenau y Monowitz-Buna), I reflect on God and evil (focusing on the children of Auschwitz), I describe Frankl's days in Auschwitz, I talk about God as hope, about immortality and escathology, I discuss God's cruelty, the relationship between Christianity and antisemitism and Islam and antisemitism, I question the silence of God, and I talk about the death of God and about the trial against God. In the fifth chapter I talk about the Franklean morality (a morality that concerns man and not God), on the basis of his love theory and his only work of theater (Synchronisation in Binkerwald), and the Sartrean morality (a morality that concerns a humanity without God), remembering Dostoyevsky, analysing Garcin's famous quote in Huis clos "L'enfer, c'est les Autres", crticizing Sartre's marxism and questioning (with Frankl's and Sartre's eyes) Brecht's verse "Erst kommt das Fressen, dann kommt die Moral"; at the end of the chapter I include my own reflection (and Frankl and Sartre's critique) about the impunity of the executioners and collaborators after the Holocaust (with God's permission). ● Sergio Cremaschi, The non-existing Island. The chapter discusses how the cleavage between the Continental and the Anglo-American philosophies originated, the (self-)images of both philosophical worlds, the converging rediscoveries from the Seventies, and recent ecumenic or anti-ecumenic strategies. I argue that pragmatism provides an important counter-instance to the familiar self-images and the fashionable ecumenic or anti-ecumenic strategies. The conclusions are: (i) the only place where Continental philosophy exists (as Euro-Communism one decade ago) is America; (ii) less obviously, also analytic philosophy (...) does not exist, or does no more exist as a current or a paradigm; what does exist is, on the one hand, philosophy of language and, on the other, philosophy of mind, that is, two disciplines; (iii) the dissolution of analytic philosophy as a school has been highly fruitful, precisely in so far as it has left room for disciplines and research programmes; (iv) what is left, of the Anglo-American/Continental cleavage is primarily differences in styles, depending partly on intellectual traditions, partly owing to sociology, history, institutional frameworks; these differences should not be blurred by rash ecumenism; besides, theoretical differences are alive as ever, but within both camps; finally, there is indeed a lag (not a difference) in the appropriation of intellectual techniques by most schools of 'Continental' philosophy, and this should be overcome through appropriation of what the best 'analytic' philosophers have produced. ● Michael Strauss, Language and sense-perception: an aspect of analytic philosophy. To test an assertion about one fact by comparing it with perceived reality seems quite unproblematic. But the very possibility of such a procedure is incompatible with the intellectualistic basis of logical positivism and atomism (as it is for example to be found in Russell's Analysis of Mind). According to the intellectualistic approach pure sensation is meaningless. Sensation receives its meaning and order from the intellect through interpretation, which is performed with the help of linguistic tools, i.e. words and sentences. Before being interpreted, sensation is not a picture or a representation, it is neither true nor false, neither an illusion nor knowledge; it does not tell us anything; it is a lifeless and order-less matter. But how can a thought (or a proposition) be compared with such a lifeless matter? This difficulty confronts the intellectualist, if on the one hand he admits the necessity of comparing thought with sense-perception, and on the other hand presupposes that we possess only intellectual and no immediate perceptual understanding of what we see and hear. In this paper I give a critical exposition of three attempts, made by Russell, Neurath and Wittgenstein, to solve this problem. The first attempt adheres to strict conventionalism, the second tends to naturalism and the third leads to an amended, very moderate version of conventionalism. This amended conventionalism looks at sense impressions as being a peculiar language, which includes primary symbols, i.e. symbols not founded on convention and not being in need of interpretation. ● Ernst Tugendhat, Phenomenology and language analysis. The paper, first published in German in 1970, by which Tugendhat gave a start to the German rediscovery of analytic philosophy. The author stages a confrontation between phenomenology and language analysis. He argues that language analysis does not differ from phenomenology as far as the topics dealt with are concerned; instead, both currents are quite different in method. The author argues that language-analytic philosophy does not simply lay out of the mainstream of transcendental philosophy, but that instead it challenges this tradition on the very level of foundations. The author criticizes the linguistic-analytic approach centred on the subject as well as any object-centred approach, while proposing inter-subjective understanding through language as the new universal framework. This is, when construed in so general terms, the same program of hermeneutics, though in a more basic version. ● Jürgen Habermas, Language game, intention and meaning. On a few suggestions by Sellars and Wittgenstein. The paper, first published in German in 1975, in which Habermas announces his own linguistic turn through a discovery of speech acts. In this essay the author wants to work out a categorical framework for a communicative theory of society; he takes Wittgenstein's concept of language game as a Leitfade and, besides, he takes advantage also of Wilfried Sellars's quasi-transcendental account of the genesis of intentionality. His goal is to single out the problems connected with a theory of consciousness oriented in a logical-linguistic sense. ● Zvie Bar-On, Isomorphism of speech acts and intentional states. This essay presents the problem of the formal relationship between speech acts and intentional states as an essential part of the perennial philosophical question of the relation between language and thought. I attempt to show how this problem had been dealt with by two prominent philosophers of different camps in our century, Edmund Husserl and John Searle. Both of them wrote extensively about the theory of intentionality. I point out an interesting, as it were unintended, continuity of their work on that theory. Searle started where Husserl left off 80 years earlier. Their meeting point could be used as the first clue in our search. They both adopted in effect the same distinction between two basic aspects of the intentional experience: its content or matter, and its quality or mode. Husserl did not yet have the concept of a speech act as contradistinguished from an intentional state. The working hypothesis, however, which he suggested, could be used as a second clue for the further elaboration of the theory. The relationship of the two levels, the mental and the linguistic, which remained for Husserl in the background only, became the cornerstone of Searle' s inquiry. He employed the speech act as the model and analysed the intentional experience by means of the conceptual apparatus of his own theory of speech acts. This procedure enabled him to mark out a number of parallelisms and correlations between the two levels. This procedure explains the phenomenon of the partial isomorphism of speech acts and intentional states. ● Roberta de Monticelli, Ontology. A dialogue among the linguistic philosopher, the naturalist, and the phenomenological philosopher. This paper proposes a comparison between two main ways of conceiving the role and scope of that fundamental part of philosophy (or of "first" philosophy) which is traditionally called "ontology". One way, originated within the analytic tradition, consists of two main streams, namely philosophy of language and (contemporary) philosophy of mind, the former yielding "reduced ontology" and the latter "neo-Aristotelian ontology". The other way of conceiving ontology is exemplified by "phenomenological ontology" (more precisely, the Husserlian, not the Heideggerian version). Ontology as a theory of reference ("reduced" ontology, or ontology as depending on semantics) is presented and justified on the basis of some classical thesis of traditional philosophy of language (from Frege to Quine). "Reduced ontology" is shown to be identifiable with one level of a traditional, Aristotelian ontology, namely the one which corresponds to one of the four "senses of being" listed in Aristotle's Metaphysics: "being" as "being true". This identification is justified on the basis of Franz Brentano's "rules for translation" of the Aristotelian table of judgements in terms of (positive and negative) existential judgments such as are easily translatable into sentences of first order predicate logic. The second part of the paper is concerned with "neo-Aristotelian ontology", i.e. with naturalism and physicalism as the main ontological options underlying most of contemporary discussion in the philosophy of mind. The qualification of such options as "neo-Aristotelian" is justified; the relationships between "neo-Aristotelian ontology" and "reduced ontology" are discussed. In the third part the fundamental tenet of "phenomenological ontology" is identified by the thesis that a logical theory of existence and being does capture a sense of "existing" and "being" which, even though not the basic one, is grounded in the basic one. An attempt is done of further clarifying this "more basic" sense of "being". An argument making use of this supposedly "more basic" sense is advanced in favour of a "phenomenological ontology". ● Kuno Lorenz, Analytic Roots in Dialogic Constructivism. Both in the Vienna Circle ad in Russell's early philosophy the division of knowledge into two kinds (or two levels), perceptual and conceptual, plays a vital role. Constructivism in philosophy, in trying to provide a pragmatic foundation - a knowing-how - to perceptual as well as conceptual competences, discovered that this is dependent on semiotic tools. Therefore, the "principle of method" had to be amended by the "principle of dialogue". Analytic philosophy being an heir of classical empiricism, conceptually grasping the "given", and constructive philosophy being an heir of classical rationalism, perceptually providing the "constructed", merge into dialogical constructivism, a contemporary development of ideas derived especially from the works of Charles S. Peirce (his pragmatic maxim as a means of giving meaning to signs) and of Ludwig Wittgenstein (his language games as tools of comparison for understanding ways of life). 7. Albrecht Wellmer, "Autonomy of meaning" and "principle of charity" from the viewpoint of the pragmatics of language. In this essay I present an interpretation of the principle of the autonomy of meaning and of the principle of charity, the two main principles of Davidson's semantic view of truth, showing how both principles may fit in a perspective dictated by the pragmatics of language. I argue that (I) the principle of the autonomy of meaning may be thoroughly reformulated in terms of the pragmatics of language, (ii) the principle of charity needs a supplement in terms of pragmatics of language in order to become really enlightening as a principle of interpretation. Besides, I argue that: (i) on the one hand, the fundamental thesis of Habermas on the pragmatic theory of meaning ("we understand a speech act when we know what makes it admissible") is correlated with the seemingly intentionalist thesis according to which we understand a speech act when we know what a speaker means; (ii) on the other hand, to say that the meaning competence of a competent speaker is basically a competence about a potential of reasons (or also of possible justifications) which is inherently connected with the meaning of statements, or with their use in utterances. ● Rüdiger Bubner, The convergence of analytic and hermeneutic philosophy This paper argues that the analytic philosophy does not exist, at least as understood by its original programs. Differences in the analytic camp have always been bigger than they were believed to be. Now these differences are coming to the fore thanks to a process of dissolution of dogmatism. Philosophical analysis is led by its own inner logic towards questions that may be fairly qualified as hermeneutic. Recent developments in analytic philosophy, e.g. Davidson, seem to indicate a growing convergence of themes between philosophical analysis and hermeneutics; thus, the familiar opposition of Anglo-Saxon and Continental philosophy might soon belong to history. The fact of an ongoing appropriation of analytical techniques by present-day German philosophers may provide a basis for a powerful argument for the unity of philosophizing, beyond its strained images privileging one technique of thinking and rejecting the remainder. Actual philosophical practice should take the dialogue between the two camps more seriously; in fact, the processes described so far are no danger to philosophical work. They may be a danger for parochial approaches to philosophizing; indeed, contrary to what happens in the natural sciences, Thomas Kuhn's "normal science" developing within the framework of one fixed paradigm is not typical for philosophical thinking. And in philosophy innovating revolutions are symptoms more of vitality than of crisis. ● Karl-Otto Apel, The impact of analytic philosophy on my intellectual biography. In my paper I try to reconstruct the history of my Auseinandersetzung mit - as I called it - "language-analytical" philosophy (including even Peircean semiotics) since the late Fifties. The heuristics of my study was predetermined by two main motives of my beginnings: the hermeneutic turn of phenomenology and the transformation of "transcendental philosophy" in the light of the "language a priori". Thus, I took issue with the early and the later Wittgenstein, logical positivism, and post-Wittgensteinian and post-empiricist philosophy of science (i.e. G.H. von Wright and the renewal of the "explanation vs understanding controversy" as well as the debate between Th. Kuhn and Popper/Lakatos); besides, with speech act theory and the debate about "transcendental arguments" since Strawson. The "pragmatic turn", started already by C.L. Morris and the later Carnap, led me to study also the relationship between Wittgensteinian "use" theory of meaning and of truth. This resulted on my side in something like a program of "transcendental semiotics", i.e. "transcendental pragmatics" and "transcendental hermeneutics". ● Ben-Ami Scharfstein, A doubt on both their houses: the blindness to non-western philosophies. The burden of my criticism is that contemporary European philosophers of all kinds have continued to think as if there were no true philosophy but that of the West. For the most part, the existentialists have been oblivious of their Eastern congeners; the hermeneuticians have yet to stretch their horizons beyond the most familiar ones; and the analysts remain unaware of the analyses and linguistic sensitivities of the ancient non-European philosophers. Briefly, ignorance still blinds almost all contemporary Western philosophers to the rich, variegated philosophical traditions outside of their familiar orbit. Both Continental and Anglo-Americans have lost the breadth of view that once characterized such thinkers as Herder and the Humboldts. The blindness that has resulted is not simply that of individual Western philosophers but of our whole, still parochial philosophical culture. (shrink)

Is the primary function of an educator to elucidate and convey their own knowledge? French philosopher Jacques Rancière demonstrates that an incidental experiment by Joseph Jacotot presents an alternative paradigm: the ignorant schoolmaster. In his work The Ignorant Schoolmaster: Five Lessons in Intellectual Emancipation [Le maître ignorant: cinq leçons sur l'émancipation intellectuelle], Rancière posits that the ignorant schoolmaster is equally, if not more, capable of instructing students compared to the knowledgeable educator. Rancière examines two educational methodologies: the conventional approach (...) of the knowledgeable educator who explicates and imparts knowledge, and the experimental approach of the ignorant schoolmaster who refrains from explanation and primarily focuses on verifying attentiveness. By providing a brief analysis of these two methodologies, this article aims to demonstrate how Rancière’s work can be utilized to construct a model for articulating the implicit theoretical principles in educational practices. This model is predicated on the following premise: by taking either a successful or a problematic educational practice as an example, one can articulate the theoretical principles inherent within it. The article hopes to facilitate a shift in focus from practices to principles, thereby offering a novel perspective on educational practices and enabling its theoretical explication......... In dit artikel wil ik op basis van een korte analyse van deze twee praktijken laten zien hoe we uit Rancière’s boek een model kunnen afleiden voor het articuleren van de theoretische principes die impliciet in onderwijspraktijken werkzaam zijn. Dit model is gestoeld op het volgende uitgangspunt: door een succesvolle of juist problematische onderwijspraktijk als voorbeeld te nemen kunnen we de theoretische principes articuleren die erin werkzaam zijn. Identifying the necessary and sufficient conditions for individuating and classifying diseases is a matter of great importance in the fields of law, ethics, epidemiology, and of course, medicine. In this paper, I first propose a means of achieving this goal, ensuring that no two distinct disease-types could correctly be ascribed to the same disease-token. I then posit a metaphysical ontology of diseases—that is, I give an account of what a disease is. This is essential to providing the most effective means (...) of interfering with disease processes. Following existing work in the philosophy of medicine and epidemiology (primarily Christopher Boorse; Caroline Whitbeck; Alexander Broadbent), philosophy of biology (Joseph LaPorte; D.L. Hull), conditional analyses of causation (J.L. Mackie; David Lewis), and recent literature on dispositional essentialism (Stephen Mumford and Rani Anjum; Alexander Bird), I endorse a dispositional conception of disease. Following discussion of various conceptions of disease-identity, their relations to the clinical and pathological effects of the diseases in question, and how diseases are treated, I conclude (i) that diseases should be individuated by their causes, and (ii) that diseases are causal processes best seen as simultaneously acting sequences of mutually manifesting dispositions. Fizica clasică se ocupă, în general, cu materia și energia la scară normală de observație, în timp ce o mare parte a fizicii moderne se ocupă de comportamentul materiei și energiei în condiții extreme sau pe o scară foarte mare sau foarte mică. De exemplu, pentru fizica atomică (...) și nucleară contează scara cea mai mică la care elementele chimice pot fi identificate. Fizica particulelor elementare are o scară chiar mai mică, deoarece se referă la unitățile de bază ale materiei; această ramură a fizicii este, de asemenea, cunoscută sub numele de fizica energiilor înalte, din cauza energiilor extrem de ridicate necesare pentru a produce mai multe tipuri de particule, în acceleratoare de particule mari. La această scară, de obicei, noțiunile obișnuite de spațiu, timp, materie și energie nu mai sunt valabile. Abordant les alternatives au capitalisme dans la pensée de Léon Bourgeois, Éliot Litalien commente La Solidarité et Simon-Pierre Chevarie-Cossette s’attaque à l’analyse de l’Essai d’une philosophie de la solidarité. Enfin, en liant capitalisme, patriarcat et pouvoir politique, Tara Chanady propose une lecture du texte Du mariage et de l’amour de Emma Goldman. George M. Searle (1839-1918) and Charles S. Peirce worked together in the Coast Survey and the Harvard Observatory during the decade of 1860: both scientists were assistants of Joseph Winlock, the director of the Observatory. When in 1868 George, a convert to Catholicism, left to enter the Paulist Fathers, he was replaced by his brother Arthur Searle. George was ordained as a priest in 1871, was a lecturer of Mathematics and Astronomy at the Catholic University of America, and became (...) the fourth superior general of his congregation from 1904 to 1909. Among the books he wrote for non-Catholic audiences was Plain Facts for Fair Minds (1895). On the 8th of August of 1895, Peirce found that book in a bookstore and the following day wrote a letter to George Searle developing his strong reservations about the question of the infallibility of the Pope. This letter (L 397) is almost unknown amongst Peirce's scholars. -/- After describing these historical circumstances as a framework, the aim of my paper is to describe Peirce's arguments against papal infallibility presented by George Searle in his book, and the contrast between the genuine scientific attitude and the putative metaphysical notion of absolute truth that is —according to Peirce— behind Searle's defense of infallibility. In this sense, Peirce's fallibilism will be explained with some detail, giving an account also of his practical infallibilism: "The assertion that every assertion but this is fallible, is the only one that is absolutely infallible. But though nothing else is absolutely infallible, many propositions are practically infallible; such as the dicta of conscience" (Minute Logic, CP 2.75, c. 1902). -/- Finally, having in mind the present interest in Peirce's religious ideas it will be suggested that some of Peirce's ideas on infallibility are nearer to contemporary understanding of that issue than Searle's defense. In recent years a growing number of philosophers in the analytic tradition have focused their attention on the significance of human sociality. An older point of departure of analysis, which actually precedes this current tide of accounts of sociality, has revolved around the debate between “holism” and “individualism” in the philosophy of the human or social sciences and social theory. The more recent point of departure for various accounts of sociality has centered on the nature of conventions, social groups, shared (...) intentions, or collective intentionality. Putting aside the disagreements among these accounts, they all take for granted an antecedently intelligible notion of individual agency as explanatorily primitive and seek to explain the possibility of plural or collective agency in terms of the former. By contrast, other philosophers who have worked at the intersection of analytic and "continental" philosophy have emphasized the primacy of practice as the proper starting point for philosophical reflections on the nature of human sociality. In the analytic tradition this emphasis is typically framed in terms of the possibility of rule-following, a topic put on the philosophical agenda by the later Wittgenstein. Peter Winch’s and Saul Kripke’s influential but controversial readings of Wittgenstein explicitly thematize the issue of rule-following, readings which have in turn generated critical reflection in various disciplines for which this issue is relevant. -/- I begin by briefly explicating the positions of Pettit and Brandom on the issue of rule-following (putting aside any specific differences between them for the moment). Next I connect Pettit’s and Brandom’s views on rule-following, and more generally on normativity and its necessarily social basis, with the views of Theodore Schatzki and Joseph Rouse, whose conceptions of the significance of practice and its inherent sociality are indebted as much to the early Heidegger as well as the later Wittgenstein. I suggest that Pettit’s and Brandom’s views of the necessarily social nature of rule-following (i.e., practice) ought to acknowledge and integrate the shared insight of Schatzki and Rouse that practices are not only modes of activity, but constitute more basically the concrete setting or world within which practices qua modes of activity are intelligible (verständlich) at all. I conclude the paper by suggesting how an integrated account of the significance of the necessarily social nature of practice undermines the assumptions of those philosophers who seek to analyze human sociality solely on the basis of modes of interactions among individual agents. In the Third Antinomy of the Critique of Pure Reason (1781) [Kritik der reinen Vernunft], Immanuel Kant (1724-1804) associates freedom with infinity. According to the definition given in this book, only an infinite being not subject to causality can be defined as free. However, the fact that a finite being, such as a human, is always subject to the laws of nature implies that they are perpetually bound by causality, which hinders their freedom. Freedom devoid of causality cannot be theoretically (...) justified. Another reason for this is Kant’s assertion in the Second Analogy of Critique of Pure Reason, where he states that everything in the phenomenal world is subject to causality. Accordingly, freedom can be conceived not in the phenomenal world but only in the noumenal world. In the First Critique, freedom, defined as a cause without a cause, a cause without being the result of another cause, later be characterized as negative freedom in the third section of the Groundwork of the Metaphysics of Morals (1785) [Grundlegung zur Metaphysik der Sitten]. Such conceptualization of freedom cannot be determined by any other cause than itself. While there may be a theoretical foundation for accepting such a cause as uncaused, we have moral reasons to believe in it. This moral foundation in question guides us toward the notion of positive freedom. Here, unlike negative freedom, we are subject to moral laws, and as long as we comply with these, we can experience freedom as a finite being. This is because adhering to the laws we set for ourselves enables us to be morally the cause of our own actions. Thus, Kant renders freedom through positive freedom. Following this line of argument, negative freedom appears meaningful to us only within the framework of positive freedom. Jean-Luc Nancy (1940-2021) finds a problematic Kantian account of freedom as an uncaused cause in his book The Experience of Freedom (1988) [L’expérience de la liberté]. Because, according to this perspective, humans are not only subject to the laws of nature but also to moral cause-and-effect relationships with others, they exist at the ix limit of freedom. By this means, considering freedom as a duty imposed on the subject leads to ambiguous analyses such as negative/positive freedom in Kantian philosophyーIn post-Kantian philosophy, the ambiguity persists until Friedrich Wilhelm Joseph Schelling (1775-1854)1 , who finds the solution by negating freedom. Therefore, according to Nancy, freedom should be considered not as a Kantian Idea but through its relationship with human finitude and experience. Thus, through the criticism directed at Kant in Martin Heidegger’s (1889-1976) Kant and the Problem of Metaphysics (1929) [Kant und das Problem der Metaphysik], Nancy attempts to resolve the confusion created by the concept of freedom, which despite being associated with infinity in Kant, is made possible in the practical world through respect for the moral law. In this direction, Nancy finds the solution in the freedom that becomes conceptually elusive, transforming it into an act that goes beyond being a mere duty and which permeates all our experiences. In this book, Nancy introduces the initial stages of “community” and “singularity” concepts, which he would later develop further. For this, he begins the book's introductory section by emphasizing Martin Heidegger’s statement in §9 of Being and Time (1927) [Sein und Zeit], where “freedom” is mentioned as another name for existence. As a justification, he refers to the concept of Da-sein [being-there] and states that every being [être] is a being-in-common [être-en-commun], and freedom should be thought of through this. Namely, the problem of freedom is approached not as a political or ethical issue but as an ontological matter. Within the framework of beingin-common, this situation transforms into an ontological “generosity [générosité ontologique].” -/- 1 Philosophical Investigations into the Essence of Human Freedom [Philosophische Untersuchungen über das Wesen der menschlichen Freiheit und die damit zusammenhängenden Gegenstände], Schelling, approaches freedom not through infinity but rather through finitude. While Heidegger and Nancy pursue different paths, they both adhere to the idea of finitude freedom in Schelling. x Despite primarily emphasizing Heidegger’s thought in writing this text as his aggrégation thesis, Jean-Luc Nancy desires to transcend it and maintain a certain distance. This transcendence and distancing include authors from the French Phenomenological tradition, such as Georges Bataille (1897-1962), Maurice Blanchot (1907-2003), and Jean-François Lyotard (1924-1998), and also incorporate the emphasis from Hannah Arendt (1906-1975) that death cannot be thought of independently of life. Referencing many philosophers from the continental philosophy tradition and developing a thematic reading through freedom, this bookーlike Nancy’s other worksーseeks ways to experience philosophy and thought freely in this own writing experience. So much so that this book, unlike Nancy’s other works like The Inoperative Community (1986) [La communauté désoeuvrée] ve Being Singular Plural (1996) [Être Singulier Pluriel], which is not widely discussed in secondary sources, is challenging to follow. Therefore, in examining this book as my Master’s research thesis and addressing the idea of freedom in Nancy, I found it appropriate to adopt a close reading method. Certainly, this research should not be considered independent of works such as The Discourse of Syncope (1976) [Le discours de la syncope], The Categorical Imperative (1983) [L’impératif catégorique], as they serve as examples of while engaging in philosophy, how Nancy refers and relates to the works within the philosophical tradition. PREMISSA No século XIX, ocorreram transformações impulsionadas pela emergência de novas fontes energéticas (água e petróleo), por novos ramos industriais e pela alteração profunda nos processos produtivos, com a introdução de novas máquinas e equipamentos. Depois de 300 anos de exploração por parte das nações europeias, iniciou -se, principalmente nas colônias latino-americanas, um processo intenso de lutas pela independência. É no século XIX, já com a consolidação do sistema capitalista na Europa, que se encontra a herança intelectual mais próxima da (...) qual surgirá a Sociologia como ciência particular. No início desse século, as ideias do Conde de Saint-Simon (1760-1825), de Georg Wilhelm Friedrich Hegel (1770-1831), de David Ricardo (1772-1823) e de Charles Darwin (1809-1882), entre outros, foram o elo para que Alexis de Tocqueville (1805-1859), Auguste Comte (1798-1857), Karl Marx (1818 -1883) e Herbert Spencer (1820-1903), entre outros, desenvolvessem reflexões sobre a sociedade de seu tempo. Auguste Comte e Karl Marx foram os pensadores que lançaram as bases do pensamento sociológico e de duas grandes tradições – a positivista e a socialista – que muito influenciaram o desenvolvimento da Sociologia no Brasil. 1 AUGUSTE COMTE E A TRADIÇÃO POSITIVISTA Isidore Auguste Marie François Xavier Comte nasceu em Montpellier, na França, em 19 de janeiro de 1798. Com 16 anos de idade, ingressou na Escola Politécnica de Paris, fato que teria significativa influência na orientação posterior de seu pensamento. De 1817 a 1824, foi secretário do Conde de Saint-Simon. Comte declarou que, com Saint -Simon, aprendeu muitas coisas que jamais encontraria nos livros e que, no pouco tempo em que conviveu com o conde, fez mais progressos do que faria em muitos anos, se estivesse sozinho. Toda a obra de Comte está permeada pelos acontecimentos que ocorreram após a Revolução Francesa de 1789. Ele defendeu parte dos princípios revolucionários e criticou a restauração da monarquia, preocupando-se fundamentalmente em reorganizar a sociedade, que, no seu entender, estava em ebulição e mergulhada no caos. Para Comte, a desordem e a anarquia imperavam em virtude da confusão de princípios (metafísicos e teológicos), que não se adequavam à sociedade industrial em expansão. Era, portanto, necessário superar esse estado de coisas, usando a razão como fundamento da nova sociedade. Propôs, então, a mudança da sociedade por meio da reforma intelectual plena das pessoas. De acordo com o pensador, com a modificação do pensamento humano, por meio do método científico, que ele chamava de “filosofia positiva”, haveria uma reforma das instituições. Com a proposta do estudo da sociedade por meio da análise de seus processos e estruturas, e da reforma prática das instituições, Comte criou uma nova ciência, à qual deu o nome de “física social”, passando a chamá-la posteriormente de Sociologia. A Sociologia representava, para Comte, o coroamento da evolução do conhecimento, mediante o emprego de métodos utilizados por outras ciências, que buscavam conhecer os fenômenos constantes e repetitivos da natureza: a observação, a experimentação, a comparação e a classificação. De acordo com esse pensador, a Sociologia, como as ciências naturais, deve sempre procurar a reconciliação entre os aspectos estáticos e os dinâmicos do mundo natural ou, no caso da sociedade humana, entre a ordem e o progresso. O lema da “filosofia positiva” proposta por Comte era “conhecer para prever, prever para prover”, ou seja, o conhecimento é necessário para fazer previsões e também para solucionar possíveis problemas. A influência de Comte no desenvolvimento da Sociologia foi marcante, sobretudo, na escola francesa, evidenciando-se em Émile Durkheim e seus contemporâneos e seguidores. Seu pensamento esteve presente em muitas das tentativas de criar tipologias para explicar a sociedade. Suas principais obras são: Curso de filosofia positiva (1830-1842), Discurso sobre o espírito positivo (1848), Catecismo positivista (1852) e Sistema de política positiva (1854). Para concluirmos, Comte explanava que para a superação da anarquia reinante na nova sociedade industrial, a filosofia positivista defendia a subordinação do progresso à ordem. O mesmo era contra o retorno de Luís XVIII ao trono: em sua concepção, a sociedade industrial que emergia requeria um governo fundado na razão. 2 A TRADIÇÃO SOCIALISTA: KARL MARX E FRIEDRICH ENGELS Karl Heinrich Marx nasceu em Tréveris, na antiga Prússia, hoje Alemanha, em 1818 e, em 1830, ingressou no Liceu Friedrich Wilhelm, nessa mesma cidade. Anos depois, foi cursar Direito na Universidade de Bonn, transferindo-se para Berlim em seguida. Pouco a pouco, entretanto, seus interesses migraram para a Filosofia, área na qual defendeu, em 1841, a tese de doutorado A diferença da filosofia da natureza em Demócrito e Epicuro. Sua vida universitária foi marcada pelo debate político e intelectual influenciado pelo pensamento de Ludwig Feuerbach (1804-1872) e, principalmente, pelo de Georg Wilhelm Friedrich Hegel (1770- 1831). Friedrich Engels (1820-1895) nasceu em Barmen (Renânia), na antiga Prússia, hoje Alemanha, filho mais velho de um rico industrial do ramo têxtil. Terminou sua formação secundária em 1837 e a partir de então sua formação intelectual foi por conta própria (autodidata), com alguns cursos universitários esparsos e de curta duração. Desde cedo começou a trabalhar nas empresas de seu pai e foi nessa condição que se deslocou para Bremen por três anos e depois foi enviado pelos pais a Manchester, na Inglaterra, onde trabalhou nas fábricas da família. Engels ficou impressionado com a miséria na qual viviam os trabalhadores das fábricas inglesas. Os dois, Marx e Engels, se encontraram em 1842, quando Marx passou a escrever para A Gazeta Renana, jornal da província de Colônia, do qual Engels era colaborador e mais tarde editor-chefe. O jornal, que criticava o poder prussiano, foi fechado em 1843, e Marx se viu desempregado. Ao perder o emprego, mudou-se para Paris, na França. Ali escreveu, em 1844, os Manuscritos econômico-filosóficos (só publicados em 1932) e, junto com F. Engels, o livro A sagrada família. Por sua vez, F. Engels, em 1844, decidiu voltar para a Alemanha, onde publicou, em 1845, A situação da classe trabalhadora na Inglaterra. Entre 1845 e 1847, Marx exilou-se em Bruxelas, na Bélgica, onde escreveu A ideologia alemã (em parceria com Friedrich Engels) e Miséria da filosofia (1847), obra na qual criticou o filósofo Pierre-Joseph Proudhon (1809-1865). Em 1848, ainda na Bélgica, a parceria com Engels se solidificou ao escreverem juntos o livreto O Manifesto Comunista. Em 1848, Marx foi expulso da Bélgica e retornou a Colônia, na Alemanha (Prússia), sempre pensando na possibilidade de uma mudança estrutural em sua terra natal. Isso, entretanto, não aconteceu e Marx foi expulso da Alemanha em 1849, ano em que migrou para Londres, na Inglaterra, onde permaneceu até o fim da vida. Lá escreveu O 18 Brumário de Luís Bonaparte (1852), sua mais importante obra de reflexão sobre a vida política europeia do século XIX, desenvolveu pesquisas e concluiu seu maior trabalho: O capital: crítica da economia política. O primeiro volume dessa obra foi publicado em 1867; os outros três, em 1885, 1894 e 1905, após a morte de Marx, revisados por F. Engels. 2.1 O contexto histórico e a obra de Marx e Engels Para situar a obra de Marx e Engels, é necessário conhecer um pouco do que acontecia em meados do século XIX. Com as transformações que ocorriam no mundo ocidental, principalmente na esfera da produção industrial, houve um crescimento expressivo no número de trabalhadores industriais urbanos, com uma consequência evidente: precariedade da vida dos operários nas cidades. As condições de trabalho no interior das fábricas eram péssimas. Os empregados eram superexplorados, alimentavam-se mal e trabalhavam em ambientes insalubres. Para enfrentar essa situação e tentar modificá-la, os trabalhadores passaram a se organizar em associações e sindicatos e a promover movimentos de reivindicação. Desenvolveu-se, então, uma discussão das condições sociais, políticas e econômicas para se definirem as possibilidades de intervenção nessa realidade. Desde o início do século XIX, muitos pensadores discutiram essas questões, nas perspectivas socialista e anarquista. Na Inglaterra podem ser citados, entre outros: William Godwin (1756-1836), Thomas Spence (1750-1814), Thomas Paine (1737-1809), Robert Owen (1771-1858) e Thomas Hodgkin (1787-1866). Na França, destacaram-se Étienne Cabet (1788- 1856), Flora Tristan (1803-1844), Charles Fourier (1772-1837) e Pierre-Joseph Proudhon (1809-1865). Marx e Engels levaram em conta esses pensadores, debatendo com alguns contemporâneos e criticando-os. Além disso, incorporaram a tradição da economia clássica inglesa, presente principalmente nas obras de Adam Smith e de David Ricardo. Pode-se dizer, portanto, que Marx e Engels desenvolveram seu trabalho com base na análise crítica da economia política inglesa, do socialismo utópico francês e da filosofia alemã. Esses dois autores não buscavam definir uma ciência específica para estudar a sociedade (como a Sociologia, para Auguste Comte) ou situar seu trabalho em um campo científico particular. Em alguns escritos, Marx afirmou que a História seria a ciência que mais se aproximava de suas preocupações, por abarcar as múltiplas dimensões da sociedade, a qual deveria ser analisada na totalidade, não havendo uma separação rígida entre os aspectos sociais, econômicos, políticos, ideológicos, religiosos, culturais etc. O objetivo de Marx e Engels era estudar criticamente a sociedade capitalista com base em seus princípios constitutivos e em seu desenvolvimento, visando dotar a classe trabalhadora de uma análise política da sociedade de seu tempo. Assim, a tradição socialista nascida da luta dos trabalhadores, muitos anos antes e em situações diferentes, tem como expressão intelectual o pensamento de Karl Marx e Friedrich Engels. Para entender as concepções fundamentais de Marx e Engels é necessário fazer a conexão entre as lutas da classe trabalhadora, suas aspirações e as ideias revolucionárias que estavam presentes no século XIX na Europa. Para eles, o conhecimento científico da realidade só tem sentido quando visa à transformação dessa mesma realidade. A separação entre teoria e prática não é discutida, pois a “verdade histórica” não é algo abstrato e que se define teoricamente; sua verificação está na prática. Apesar de haver algumas diferenças em seus escritos, os elementos essenciais do pensamento de Marx e Engels podem ser assim sintetizados: • historicidade das ações humanas – crítica ao idealismo alemão; • divisão social do trabalho e o surgimento das classes sociais – a luta de classes; • o fetichismo da mercadoria e o processo de alienação; • crítica à economia política e ao capitalismo; • transformação social e revolução; • utopia – sociedade comunista. A obra desses dois autores é muito vasta e não ficou vinculada estritamente aos movimentos sociais dos trabalhadores. Pouco a pouco foi introduzida nas universidades como parte do estudo em diferentes áreas do conhecimento. Estudiosos de Filosofia, Sociologia, Ciência Política, Economia, História e Geografia, entre outras áreas, foram influenciados por ela. Na Sociologia, como afirma Irving M. Zeitlin, no livro Ideología y teoría sociológica, tanto Max Weber quanto Émile Durkheim fizeram, em suas obras, um debate com as ideias de Karl Marx. Pelas análises da sociedade capitalista de seu tempo e a repercussão que tiveram em todo o mundo, principalmente no século XX, nos movimentos sociais e nas universidades, Marx e Engels são considerados autores clássicos da Sociologia. No campo dessa disciplina, porém, o pensamento deles ficou um pouco restrito, pois perdeu aquela relação entre teoria e prática (práxis), ou seja, entre a análise crítica e a prática revolucionária. Essa relação esteve presente, por exemplo, na vida e na obra dos russos Vladimir Ilitch Ulianov, conhecido como Lênin (1870-1924), e Leon D. Bronstein, conhecido como Trotsky (1879-1940), da alemã Rosa Luxemburgo (1871-1919) e do italiano Antonio Gramsci (1891- 1937), que tiveram significativa influência no movimento operário do século XX. Com base no trabalho de Marx e Engels, muitos autores desenvolveram estudos acadêmicos em vários campos do conhecimento. Podemos citar, por exemplo, Georg Lukács (1885-1971), Theodor Adorno (1903-1969), Walter Benjamin (1892-1940), Henri Lefebvre (1901-1991), Lucien Goldmanm (1913 -1970), Louis Althusser (1918 -1990), Nikos Poulantzas (1936-1979), Edward P. Thompson (1924-1993) e Eric Hobsbawm (1917 -2012). O pensamento de Marx e Engels continua, assim, presente em todo o mundo, com múltiplas tendências e variações, sempre gerando controvérsias. WhatsApp: (82)9.8143-8399. -/- PREMISSA -/- Na Alemanha, a Sociologia foi profundamente influenciada pela discussão filosófica, histórica e metodológica que se desenvolveu entre o final do século XIX e o início do século XX. Em seus fundamentos encontra-se (...) o pensamento de vários filósofos, como Johann Gottlieb Fichte (1762 -1814), Friedrich Wilhelm Joseph von Schelling (1775 -1854), Friedrich Daniel Ernst Schleiermacher (1768 -1834), Georg Wilhelm Friedrich Hegel (1770 -1831) e Friedrich W. Nietzsche (1844-1900). -/- O representante mais expressivo da Sociologia alemã é Max Weber (1864-1920). Outros pensadores, entretanto, contribuíram significativamente para a formação e o desenvolvimento da Sociologia na Alemanha, entre os quais Ferdinand Tönnies (1855 -1936), Werner Sombart (1863-1941), Georg Simmel (1858-1918) e os estudiosos que a partir da década de 1920 constituíram a chamada Escola de Frankfurt. -/- A obra desses autores liga-se fortemente ao processo de unificação alemã, promovido somente após o triunfo de Otto von Bismarck na Guerra Franco-Prussiana (1871), e à aceleração da industrialização alemã. Esses dois fatores conferiram à Alemanha uma situação muito diferente da de outros países europeus. -/- A alteração nas estruturas de poder, na Alemanha, não ocorreu por meio de uma revolução, como na França, mas por um acordo entre a bur-guesia industrial e os grandes proprietários de terra, tendo em vista uma transição mais adequada aos seus interesses. -/- Vale salientar, em nota, que após a Guerra Franco-Prussiana (1870-71), os príncipes alemães se reuniram no palácio de Versalhes (França), onde aclamaram Guilherme I, da Prússia, como o imperador alemão. Assim surgia o Império da Alemanha, em 1871. -/- A burguesia industrial não estava preocupada em alterar de modo significativo a estrutura fundiária, e os grandes proprietários, que se encastelaram na burocracia estatal, não permitiram a formulação de uma legislação trabalhista que prejudicasse os interesses da burguesia. Assim se fez uma mudança “por cima”, sem levar em conta os interesses dos trabalhadores urbanos ou rurais. Destacam-se aqui dois importantes soció-logos alemães: Georg Simmel e Max Weber, pela presença no Brasil. Depois, brevemente, falar-se-á aqui da famosa Escola de Frankfurt. -/- 1. Georg Simmel (1858-1918) -/- Nascido em Berlim, Georg Simmel é um pensador difícil de enquadrar em alguma tendência ou campo específico do conhecimento. Vamos ler um trecho do que escreveu sobre ele o sociólogo brasileiro Leopoldo Waizbort: -/- Quem tentar esboçar a fisionomia de Georg Simmel (1858-1918), logo se encontra em meio a dificuldades que são características próprias daquilo que se quer apreender. Simmel sempre postulou para seu próprio pensamento uma mobilidade e uma plasticidade para se adaptar ao seu objeto – uma multiplicidade de direções, uma defesa do fragmento –, que se opõem a toda tentativa de fixação e acabamento, a toda pretensão de sistema. Por isso todos os rótulos que lhe são atribuídos, apesar de possuírem seu teor de verdade, sempre soam tão falsos: vitalismo, relativismo, esteticismo, formalismo, irracionalismo, psicologismo, impressionismo e tantos mais. Disto também é exemplo o fato de Simmel, hoje considerado, ao lado de Max Weber e Ferdinand Tönnies, um dos “pais” da sociologia alemã, não poder ser classificado sem mais como “sociólogo”, sob pena de se perderem várias outras dimensões que são essenciais ao seu pensamento (WAIZBORT, 2000. p. 11). -/- G. Simmel foi o último dos sete filhos de um próspero comerciante judeu convertido ao cristianismo. Com a morte do pai, herdou uma fortuna considerável que lhe permitiu independência para desenvolver a vida acadêmica. Estudou História e Filosofia na Universidade de Berlim, onde foi aluno das mais importantes figuras acadêmicas da época. Em 1881, defendeu uma tese sobre Immanuel Kant e recebeu o título de doutor em Filosofia. Entre 1885 e 1914, lecionou Filosofia, Ética e Sociologia na Universidade de Berlim, mas nunca foi incorporado formalmente à universidade. -/- Ocupou o cargo de professor titular de Filosofia somente em 1914, em Estrasburgo, cidade onde permaneceu até a morte, em 1918. -/- Na virada do século XIX para o século XX na Alemanha, houve uma intensa efervescência filosófica, cultural e artística, cenário em que se desenvolveram a psicanálise, a teoria da relatividade, o positivismo lógico e a música atonal. Nesse cenário, Simmel tornou-se um conferencista muito aclamado e escreveu artigos e ensaios sobre os mais variados temas da Filosofia, como lógica, teoria do conhecimento, ética, estética ou metafísica, além de temas da Psicologia, da Sociologia, da História e da religião. -/- Escreveu também muitas biografias (de Johann Wolfgang von Goethe, de Friedrich Nietzsche, de Immanuel Kant e de Rembrandt, entre outros). -/- Suas obras sociológicas mais importantes são: Da diferenciação social (1890), A filosofia do dinheiro (1907), Sociologia (1908) e Questões fundamentais da Sociologia (1917). Georg Simmel teve influência marcante no desenvolvimento da Sociologia na Alemanha, nos Estados Unidos (em especial na Escola de Chicago) e na França (em Durkheim e seus colaboradores diretos). Suas obras foram traduzidas para o francês e o inglês, muitas vezes antes de ser publicadas em alemão. -/- 2. Max Weber (1864-1920) -/- Max Weber nasceu em 21 de abril de 1864, em Erfurt, e morreu em Munique, em 1920. De família abastada, teve uma educação formal de boa qualidade, o que lhe permitiu uma erudição notável. Com 18 anos, ingressou na Universidade de Heidelberg, onde escolheu como área de concentração o Direito e como correlatas a História, a Filosofia e a Economia. Nessa universidade, teve o primeiro contato com os escritos de Immanuel Kant e com neokantianos, os quais nunca deixou de lado em seus estudos. -/- Em 1889, concluiu o doutorado em Direito Comercial com uma tese sobre a história das sociedades comerciais da Idade Média. Em 1891, defendeu outra tese: A importância da história agrária romana para o direito público e privado. Em 1894, tornou-se professor de Economia na Universidade de Freiburg e, dois anos depois, transferiu-se para a Universidade de Heidelberg. -/- A partir de 1897, acometido de uma depressão profunda, não conseguiu desenvolver as atividades acadêmicas. Entre 1902 e 1903, retomou as atividades intelectuais, mas fora da universidade, pois não tinha condições psicológicas para ministrar aulas. No ano seguinte, tornou-se coeditor do Arquivo de Ciências Sociais, publicação muito importante para o desenvolvimento dos estudos sociológicos na Alemanha. -/- Entre agosto e dezembro de 1904, viajou, com Ferdinand Tönnies e Werner Sombart, aos Estados Unidos, por ocasião da Exposição Universal de Saint-Louis, onde entrou em contato com as igrejas e seitas protestantes daquele país e também com vários escritos de Benjamin Franklin (1706-1790), o que foi fundamental para suas pesquisas sobre a relação entre a ética protestante e o capitalismo. -/- Em 1907, recebeu uma herança significativa. A partir de então, dedicou-se exclusivamente à investigação histórica e sociológica. Em 1909, colaborou na fundação da Sociedade Alemã de Sociologia. Ao ser deflagrada a Primeira Guerra Mundial, em 1914, Weber foi convocado como oficial da reserva para dirigir um hospital militar. Entre as atividades no hospital encontrou tempo para continuar a escrever partes do livro que foi publicado postumamente por sua esposa, com o título Economia e sociedade. Além disso, desenvolveu estudos sobre ética econômica e as religiões universais e escreveu uma série de artigos para os grandes jornais da Alemanha. Nesses artigos, criticou a estrutura partidária do país e a burocratização das esferas políticas na Alemanha, afirmando que aquela situação ainda era a herança de Otto von Bismarck. -/- Em 1917, pronunciou uma conferência – A ciência como vocação – e produziu um escrito, no qual explicitou seu método – Ensaio sobre neutralidade axiológica nas ciências sociológicas e econômicas. -/- Pelas ideias expostas em debates e nos jornais e por sua erudição, Max Weber, após a derrota alemã na Primeira Guerra Mundial, fez parte da comissão que redigiu, em 1919, a nova constituição política alemã, conhecida como a Constituição de Weimar. -/- Pode-se afirmar que a vida de Max Weber foi dedicada aos estudos, à pesquisa e à participação ativa na política alemã de seu tempo, por meio de conferências e artigos para jornais e revistas. -/- Weber não media esforços para analisar e com-preender mais profundamente os temas que elegia. Desse modo, o ponto de partida da Sociologia é a compreensão da ação dos indivíduos, atuando e vivenciando situações sociais com determinadas motivações e intenções. Instituições como Estado e família só ganham sentido quando vistas da perspectiva das relações sociais. Assim, Max Weber não concebe a sociedade como um bloco, uma estrutura una, mas como uma teia de relações capazes de produzir sentido. -/- A obra de Max Weber é vasta e engloba história, direito e economia, passando pelas questões religiosas, pelos processos burocráticos, pela análise da cidade, da música e, enfim, pela discussão metodológica das ciências humanas e dos conceitos sociológicos. -/- Entre os seus escritos, podemos destacar: A ética protestante e o “espírito” do capitalismo (1904-1905/1920), A ciência como vocação (1917), A política como vocação (1919), Economia e sociedade (1920), História geral da economia (1923) e Ensaios reunidos de sociologia da religião (1917/1920). -/- Outros sociólogos alemães mantiveram-se em atividade após a Primeira Guerra Mundial, como Ferdinand Tönnies, Leopold von Wiese (1876 -1969), Hans Freyer (1887-1969) e Franz Oppenheimer (1864 -1943), que fundou, em 1919, a primeira cátedra de Sociologia na Alemanha, em Frankfurt. -/- 3. A Escola de Frankfurt -/- Logo após a morte de Max Weber, abriu-se um novo horizonte para a Sociologia alemã com a fundação do Instituto de Pesquisa Social, vinculado à Universidade Johann Wolfgang Goethe de Frankfurt, que ficou conhecido como Escola de Frankfurt. Em 1923, um grupo de intelectuais – entre eles Friedrich Pollok (1894-1970), Leo Löwenthal (1900-1993), Karl August Wittfogel (1896-1988), Max Horkheimer (1895-1973) e Theodor Adorno (1903-1969) – desenvolveu uma análise da sociedade contemporânea com base em concepções filosóficas de Immanuel Kant, Friedrich Hegel e Friedrich Nietzsche, em visões sociológicas de Karl Marx e de Max Weber e no pensamento de Sigmund Freud. -/- Os integrantes do grupo de Frankfurt pretendiam desenvolver uma teoria crítica da sociedade capitalista e buscavam explicar fenômenos que iam da análise da personalidade autoritária à indústria cultural. Mantiveram a crítica ao positivismo e ao pragmatismo, procurando demonstrar a necessida-de de refletir sobre as condições que permitiram a emergência do nazismo e sobre o significado dessa ideologia. As reflexões desses intelectuais culminaram com uma crítica à razão instrumental e às formas de controle sobre a sociedade contemporânea. -/- Além dos estudiosos citados, são representantes desse pensamento Walter Benjamin (1892-1940), Erich Fromm (1900-1980) e Herbert Marcuse (1898-1979), entre outros. Todos os integrantes da Escola de Frankfurt precisaram sair da Alema-nha por causa da perseguição nazista. Adorno e Horkheimer voltaram ao país depois do fim da Segunda Guerra Mundial. In this article, I put forward an approach to business ethics that focuses on the notion of “implicit morality of the market”. I therefore try to identify the main components of this implicit morality of the market and expose the advantages of taking such a stance to think about the obligations of firms. In order to do so, I try to shed some light, drawing on recent works by Joseph Heath, on the potential normative role of the concept of (...) market failures as articulated in economic theory. I finish by examining three problems that this approach is facing.RÉSUMÉDans cet article, je mets en avant une approche de l’éthique du commerce centrée sur la notion de « moralité implicite du marché ». J’essaie d’identifier les grands traits de cette moralité impli- cite du marché en plus d’exposer les avantages d’adopter une telle approche pour penser les obli- gations des firmes. Pour ce faire, je tente, en m’inspirant de travaux récents de Joseph Heath, de mettre en lumière le rôle proprement normatif que peut jouer le concept de défaillances des mar- chés tel que développé dans la théorie économique. According to Arthur Danto, it is illegitimate to seek a neutral, or pre-interpretative, description of an artwork, since such descriptions necessarily fail to respect the artwork as such. Instead, we must begin by interpreting, so as to constitute the work : interpretation is what distinguishes artworks from mere physical objects. In this paper, I argue that, while Danto is right to distance artworks from mere things, this can be done without suggesting that artworks are constituted by interpretation. Moreover, Danto’s view (...) leaves us unable to account for the fact that interpretations are constrained to be responsive to the work’s features. I demonstrate that, by appealing to conventions of description that are specific to art, it is possible to offer a neutral description that respects the work as an artwork. This view accords with our common sense understanding of the relation between description and interpretation, and avoids the unfortunate consequences of Danto’s theory. // Selon Arthur Danto, il est illégitime de chercher une description « neutre » ou préinterprétative d’une oeuvre d’art, parce qu’une telle description ne peut respecter l’oeuvre d’art en tant que telle. Nous ne pouvons aborder une oeuvre sans l’interpréter, puisque l’interprétation constitue l’oeuvre d’art et distingue celle-ci d’un simple objet physique. Dans cet article je soutiens que, bien que Danto ait raison de vouloir distinguer les oeuvres d’art des simples choses, on peut effectuer cette distinction sans conclure que les oeuvres d’art sont constituées par l’interprétation. Je soutiens en outre que le point de vue de Danto ne nous permet pas de tenir compte du fait que les interprétations doivent respecter les caractéristiques de l’oeuvre. Je montre qu’en faisant appel aux conventions de description spécifiques à l’art, on peut proposer une description neutre qui respecte l’oeuvre d’art en tant qu’oeuvre. Mon point de vue est conforme à la relation généralement admise entre la description et l’interprétation des oeuvres d’art, et évite les conséquences négatives de la théorie de Danto. (shrink)

Our ordinary and theoretical talk are rife with “framing devices”: expressions that function, not just to communicate factual information, but to suggest an intuitive way of thinking about their subjects. Framing devices can also play an important role in individual cognition, as slogans, precepts, and models that guide inquiry, explanation, and memory. At the same time, however, framing devices are double-edged swords. Communicatively, they can mold our minds into a shared pattern, even when we would rather resist. Cognitively, the intuitive (...) power of a frame can blind us both to known features that don’t fit easily within the frame, and also to “unknown unknowns” we have not yet encountered. Thus, perhaps Locke is right to disavow such “eloquent inventions” as “perfect cheats” that “insinuate wrong ideas, move the passions, and thereby mislead the judgment.” Against this, I argue that while the metaphor of double-edged swords is indeed apt, this is because frames are tools for thought. Like any tool, they can be used well or badly; but they do not fall outside the realm of rationality altogether. I describe how framing devices express open-ended perspectives, which produce structured intuitive characterizations of particular subjects. I argue that frames can make effective, distinctive epistemic contributions in the course of inquiry, and that the cognitive structures that frames produce can contribute to, and constitute, epistemic achievements in their own right, even in highly idealized circumstances at the nominal end of inquiry. Throughout, I focus especially on scientific understanding, because it serves as a paradigm case of rational inquiry, from which frames and perspectives are most likely to be excluded. (shrink)

Concerns about the risks of unmitigated greenhouse gas emissions are growing. At the same time, confidence that international policy agreements will succeed in considerably lowering anthropogenic greenhouse gas emissions is declining. Perhaps as a result, various geoengineering solutions are gaining attention and credibility as a way to manage climate change. Serious consideration is currently being given to proposals to cool the planet through solar-radiation management. Here we analyze how the unique and nontrivial risks of geoengineering strategies pose fundamental questions at (...) the interface between science and ethics. To illustrate the importance of integrated ethical and scientific analysis, we define key open questions and outline a coupled scientific-ethical research agenda to analyze solar-radiation management geoengineering proposals. We identify nine key fields of coupled research including whether solar-radiation management can be tested, how quickly learning could occur, normative decisions embedded in how different climate trajectories are valued, and justice issues regarding distribution of the harms and benefits of geoengineering. To ensure that ethical analyses are coupled with scientific analyses of this form of geoengineering, we advocate that funding agencies recognize the essential nature of this coupled research by establishing an Ethical, Legal, and Social Implications program for solar-radiation management. Faulkner a bâti une partie de sa renommée sur la violence parfois controversée de ses récits. Mais l’acte criminel retient moins son attention que son contexte et sa signification morale. L’objet premier de la littérature, selon Faulkner, ce sont les conflits de l’homme, ou du cœur humain, avec eux-mêmes. Le propos de cet article est de mettre en évidence la façon dont Faulkner subvertit le modèle du roman noir, et substitue à l’enjeu traditionnel des histoires policières, celui des faits et (...) de l’identité du coupable, un problème moral. Il donne quelques indications sur la structure générale des rapports crime-culpabilité dans l’œuvre de Faulkner, avant de montrer comment cette thématique se décline dans ses « histoires de crime » au sens propre, c’est-à-dire dans L’Intrus (Intruder in the dust, 1948) et Le Gambit du cavalier, et irrigue la reconstitution faulknérienne de la société du Sud et de l’histoire des États-Unis. Slurs are incendiary terms so much that many ordinary speakers and theorists deny that sentences containing them can ever be true, and utterances where they occur embedded within normally "quarantining" contexts, like conditionals and indirect reports, are still typically offensive. At the same time, however, many speakers and theorists also find it obvious that sentences containing slurs can be true; and there are clear cases where embedding does inoculate a speaker from the slur's offensiveness. I argue that four standard accounts (...) of the "other" element that differentiates slurs from their more neutral counterparts semantic content, perlocutionary effect, presupposition, and conventional implicature all fail to account for this puzzling mixture of intuitions about truth, and for this mixture of projection and quarantining. Instead, I propose that slurs make two distinct, coordinated contributions to a sentence's conventional communicative role: predication of group membership and endorsement of a derogating perspective on the group. Predication of group membership is "at issue" by default, but different semantic and conversational contexts can alter the relative prominence and scope of the two contributions. (shrink)

I distinguish among a range of distinct representational devices, which I call "frames", all of which have the function of providing a perspective on a subject: an overarching intuitive principle or for noticing, explaining, and responding to it. Starting with Max Black's metaphor of metaphor as etched lines on smoked glass, I explain what makes frames in general powerful cognitive tools. I distinguish metaphor from some of its close cousins, especially telling details, just-so stories, and analogies, in ordinary cognition and (...) communication. And I use these distinctions to illustrate different sorts of gaps that frames or models can open up between representation and reality. (shrink)

In this paper we attempt to reply to the thoughtful comments made on our book, Responsible Brains, by a stellar group of scholars. Our reply focuses on two topics discussed in the commenting papers: first, the issue of responsibility for negligent behavior; and second, the broad claim that facts about brain function are normatively inert. In response to worries that our theory lacks normative implications, we will concentrate on an area where our theory has clear relevance to law and legal (...) policy: juvenile responsibility. Most opponents of somatic cell nuclear transfer and embryonic stem cell technologies base their arguments on the twin assertions that the embryo is either a human being or a potential human being, and that it is wrong to destroy a human being or potential human being in order to produce stem cell lines. Proponents’ justifications of stem cell research are more varied, but not enough to escape the charge of obsession with the status of the embryo. What unites the two (...) warring sides in ‘the stem cell wars’ is that women are equally invisible to both: ‘the lady vanishes.’ Yet the most legitimate property in the body is that which women possess in their reproductive tissue and the products of their reproductive labour. By drawing on the accepted characterisation in the common law of property as a bundle of rights, and on a Hegelian model of contract as mutual recognition, we can lessen the impact of the tendency to regard women and their ova as merely receptacles and women’s reproductive labour as unimportant. In their writings on Africa and colonialism, John and Jean Comaroff have explored some of the fundamental questions of social science, delving into the nature of history and human agency, culture and consciousness, ritual and representation. How are human differences constructed and institutionalized, transformed and (sometimes) resisted? How do local cultures articulate with global forms? How is the power of some people over others built, sustained, eroded, and negated?These essays work toward an "imaginative sociology," demonstrating the techniques by which social (...) science may capture the contexts that human beings construct and inhabit. In the introduction the authors offer their most complete statement to date on historical anthropology. Standing apart from the traditional disciplines of social history and modernist social science, their work is dedicated to discovering how human worlds are made and signified, forgotten and remade. In Big Gods, Norenzayan (2013) presents the most comprehensive treatment yet of the Big Gods question. The book is a commendable attempt to synthesize the rapidly growing body of survey and experimental research on prosocial effects of religious primes together with cross-cultural data on the distribution of Big Gods. There are, however, a number of problems with the current cross-cultural evidence that weaken support for a causal link between big societies and certain types of Big Gods. Here we attempt to (...) clarify these problems and, in so doing, correct any potential misinterpretation of the cross-cultural findings, provide new insight into the processes generating the patterns observed, and flag directions for future research.
